MISS BIKINI ships throughout the country, Europe and most countries outside the European Union. For orders placed outside EU territory, it is important to note that the customer will be charged customs charges, which are necessary for customs clearance purposes. MISS BIKINI in the case of the consumer exercising his right of withdrawal, has the option not to accept the return of products that lack the relevant tag or that have been altered in their essential and qualitative characteristics or that have been damaged.
MISS BIKINI offers its customers a complete SATISFIED or REFUNDED guarantee. If you are not convinced of how much you purchased, you have 14 days to return it to MISS BIKINI and get a full refund(*) of the expense you made. The right of withdrawal is exercised by sending, within the required deadline, a written communication to the following email address: shop@missbikini.com
The Right of Withdrawal shall be understood to be exercised correctly where the following conditions are also fully complied with
• Products must not have been used, worn, washed or damaged; • The identification tag must still be attached to products with a disposable seal; • Products must be returned in their original packaging; • Products must be accompanied by the return coupon that is contained in the package; • Returned products must be sent to MISS BIKINI in one shipment only. MISS BIKINI, in fact, reserves the right not to accept items from the same order, returned and shipped at different times; • Miss Bikini must receive the returned products within thirty (30) business days starting from the date on which you received the products.
If the Right of Withdrawal is exercised following the methods and time limits indicated in the previous paragraph, MISS BIKINI shall reimburse any sums already collected for the purchase of the products, net of the shipping costs for the delivery of the purchased products.
MISS BIKINI will return to you, in addition to the sums collected for the purchase of the products, also the shipping costs for the delivery of the purchased products, only in the case that the return of the products occurs for causes attributable to MISS BIKINI, as in the case that the products do not possess the essential characteristics promised, or have manufacturing defects.
If the procedures and deadlines for exercising your right of withdrawal are not respected, as specified, you will not be entitled to reimbursement of the sums already paid MISS BIKINI; however, you may regain, at your own expense, the products in the state in which they were returned to MISS BIKINI. Otherwise, MISS BIKINI may retain the products, in addition to the sums already paid for their purchase.
Having disputed the integrity of the goods and seals,MISS BIKINI will refund the customer within 30 working days of the return date of the goods. It will be the customer's care to provide MISS BIKINI with the bank details (necessary only if the order has been paid in cash on delivery), in order to obtain the price return.
(*) In case of warranty refund, the customer is responsible for the costs of returning the goods to MISS BIKINI. Delivery costs to the customer will also not be refunded.
The right to withdraw from the contract concluded with MISS BIKINI can be exercised without any penalty and without specifying the reason,within 15 working days of the day of receipt of the products purchased on shopmissbikini.it. It is understood that, according to the provisions of Article 67 of the Consumer Code, the substantial integrity of the product is an essential condition for the exercise of the right of withdrawal: therefore, used items will not be refunded and/or deteriorated as a result of ordinary use. Returned goods will be refunded by reversal of the original payment transaction, within 15 days of the return verification date.

Contested the integrity of goods and seals, MISS BIKINI will make the refund to the customer within 15 working days from the date of return to the company of the goods. We will issue the refund of returned garments by reversing the original payment, therefore directly on credit card, or through PayPal (based on how you paid for the order). In that regard we remind you that the time of crediting your credit card does not depend on us, but on the contract you have agreed with the card manager itself.
ATTENTION!! We encourage you to take great care in selecting the color of the product for sale. Any errors in the choice of variant will be replaced at the customer's expense. Remember that the items must arrive intact and in the same state as received, provided with the original packaging and barcode tags and any other materials that may be part of the packaging. The freight costs for the original shipment of the order will not be refunded.
WARNING: For orders outside the European Union, customs costs will be charged. These change according to the country and the goods ordered, so Miss Bikini is not aware of the amount until she arrives at the destination customs. VAT number IT17103761007 , Via Bolzano 28, 00198 Rome, Tel. +390633220067, mail: shop@missbikini.com c)Purchase transactions are regulated, among other things, by the provisions of Legislative Decree no. 206 of 06.09.2005 (Consumption Code) pursuant to which: I) “online sales contract” means the distance contract, i.e. the legal transaction involving movable goods and/or services stipulated between a professional, in this case, FASHION ONLINE SRLS., through the online service www.missbikini.it, and a consumer, within a distance selling system organized by the professional who, for this contract, uses exclusively the distance communication technology called the Internet; II) “professional” means the natural or legal person acting in the exercise of their entrepreneurial or professional activity, or their intermediary; III) “consumer” means the natural person of legal age who acts for purposes unrelated to any entrepreneurial or professional activity carried out.

ART. 2 SELLING PRICES AND PURCHASING METHODS a) All selling prices of the products displayed and indicated on the website www.missbikini.it for which they constitute a public offering pursuant to art. 1336 of the Civil Code, include VAT and any other taxes relating to sales. b) The total cost of shipping and transportation will be clearly indicated and displayed before completing the order. c) The purchase contract is finalized through the exact completion and consent to purchase expressed through the given consent “online”, unless the payment is successful. d) the customer can pay for the ordered goods using the payment methods indicated “online” at the time of purchase.
ART. 3 DELIVERY MODALITÁ a)Shipping costs Shipping costs are calculated based on the destination state. Italy and the Republic of San Marino – € 8.00. For other destinations, the price is variable.
b) FASHION ONLINE SRLS. will return the selected and ordered products to the trusted courier, thus completing delivery, so that they can be transported to the customer at the address indicated by the customer. c) FASHION ONLINE SRLS. will do everything possible to fulfill the orders transmitted within 7 working days and in any case the purchased goods will be delivered within the deadlines set forth in art. 54 of Legislative Decree 205/06, within 14 days from the day following that on which the consumer has transmitted the order to the professional. No liability may be attributed to MISS BIKINI for delayed or non-delivery attributable to force majeure or fortuitous event. d) the customer is required to verify, at’ the receipt document, the conformity of the product delivered to him with the order placed; only after such verification, and obviously without prejudice to the right of withdrawal provided for in point no. 6, will the customer have to sign the receipt documents. By completing the personal data sheet in the registration procedure necessary to activate the process for the execution of this contract and the related further communications, the consumer and/or customer authorizes FASHION ONLINE SRLS. to communicate the non-sensitive personal data (residence, telephone number) to the couriers and/or trusted freight forwarders used to deliver the purchased goods in such a way as to allow the procedures necessary for their delivery. e) Customs charges are always borne by the customer.
ART. 4 RESPONSIBLE: a) FASHION ONLINE SRLS. assumes no responsibility for any disruptions attributable to force majeure, such as, for example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevented, in whole or in part, performance within the timeframes agreed upon in the contract. b) FASHION ONLINE SRLS. will not be liable to any party or third party for damages, losses, and costs incurred as a result of the failure to perform the contract for the reasons cited above, the customer being entitled only to the refund of the price paid. c) Likewise, FASHION ONLINE SRLS. is not responsible for any fraudulent or unlawful use that may be made by third parties of credit cards, checks and other means of payment, when paying for the products purchased. FASHION ONLINE SRLS. , in fact, at no point during the d’ purchase procedure is it able to know the customer's credit card number which, by opening a protected connection, is transmitted directly to the banking service manager.
ART. 5 CUSTOMER OBLIGATIONS a) FASHION ONLINE SRLS. produces and sells high-quality clothing and accessories; however, if the products ordered are found to be defective, the consumer is required to report the defect in writing via email within ten days of discovery, under penalty of forfeiture. b) the customer undertakes and obliges himself, once the purchase procedure “online” has been concluded, to ensure the printing and preservation of these general conditions, which, moreover, it will have already seen and accepted as an obligatory step in the purchase, as well as of the specifications of the product being purchased, and this in order to fully satisfy the condition set out in Articles 52 and 53 of Legislative Decree 205/06; c) a strict prohibition is placed on minors from completing an order “online”. d) a strict prohibition is placed on the customer from entering false, and/or invented, and/or fictitious data into the registration procedure necessary to activate the process for the execution of this contract and the related further communications; personal data, address, The telephone number and email address must be exclusively your actual personal data, not that of third parties, or fictitious data. e) Entering third-party data is expressly prohibited. ART. 6 RIGHT OF WITHDRAWAL AND COMPLAINTS a) Pursuant to Article 64 of Legislative Decree 205/06, consumers may exercise their right of withdrawal and return the product received, in compliance with the terms and procedures set out below. b) Consumers who, for any reason, are dissatisfied with the purchase made have the right to withdraw from the contract stipulated within 15 days of the delivery date. c) If the consumer has exercised the right of withdrawal, he must make the return request following the procedure provided. In this case the Company will respond to you in the shortest possible time providing all the necessary indications for the right resolution of the problem.
ART. 7 PAYMENT MODALITÁ a) By filling out the appropriate space on the payment banking system website, the consumer and/or customer authorizes FASHION ONLINE SRLS to use their credit card and debit their account with the amount shown as the cost of the purchase made “online”. The entire process takes place via a protected connection directly connected to the banking institution that owns and operates the online payment service, which FASHION ONLINE SRLS. cannot access. b) If the consumer avails himself of the right of withdrawal, as provided for in these contractual conditions, the amount to be refunded will be credited directly to the credit card or PayPal account.
ART. 8 EXPRESS TERMINATION CLAUSE a) FASHION ONLINE SRLS. has the right to terminate the contract entered into by simply notifying the consumer and/or customer with adequate and justified reasons; in this case, the customer will be entitled exclusively to the refund of any sum already paid. b) The obligations assumed by the customer referred to in art. 7 of these conditions (customer obligations) as well as the guarantee of the successful completion of the payment that the customer makes by the means referred to in Article 2, are essential, so that by express agreement, the customer's failure to fulfill only one of the said obligations will determine the legal termination of the contract pursuant to Article 1456 of the Civil Code, without the need for a judicial ruling, without prejudice to the right for FASHION ONLINE SRLS. to sue for compensation.
ART. 9 JURISDICTION AND COMPETENT COURT a) Any dispute relating to the application, execution, interpretation, and violation of purchase contracts stipulated “online” via the website www.missbikini.it is subject to Italian jurisdiction; these general conditions are referred, although not expressly provided for therein, to the provisions of the Civil Code, as well as to the Legislative Decree. 205/06. b) For any dispute between the parties regarding this contract, the court in whose district the consumer has his domicile will have jurisdiction.

TIME AND METHOD OF REFUND Contested the integrity of goods and seals, MISS BIKINI will make the refund to the customer within 15 working days from the date of return to the company of the goods. It will be the customer's care to provide MISS BIKINI with the bank details (Cod. ABI CAB Current Account of the holder of the delivery note), in order to obtain the refund of the price.
