For orders placed outside the EU, it is important to note that the customer will be charged for customs duties, necessary for customs clearance. Since duties/taxes are calculated based on the country of destination and the goods purchased, it is not possible for MISS BIKINI to know this amount before the goods arrive at their destination, for this reason the courier will interface directly with the customer for customs clearance procedures and payment of the amount to be paid for the same. The images and colours of the products offered for sale may however not correspond to the real ones due to the Internet browser and monitor used. Product prices may be subject to updates. Make sure of the final sale price before sending the relevant order form. All products are provided with an identification tag fixed with a disposable seal. In the event of the consumer exercising the right of withdrawal, MISS BIKINI has the right to not accept the return of products that are missing the relevant tag or that have been altered in their essential and qualitative characteristics or that have been damaged.
MISS BIKINI offers its customers a complete SATISFACTION or REFUND guarantee. If you are not satisfied with what you purchased, you have 14 days to return it to MISS BIKINI and obtain a full refund (*) of the expense incurred. The right of withdrawal is exercised by sending, within the deadline, a written communication to the following email address: shop@missbikini.com
The Right of Withdrawal is considered to be correctly exercised if the following conditions are also fully respected:
• The products must not have been used, worn, washed or damaged; • The identification tag must still be attached to the products with a disposable seal; • The products must be returned in their original packaging; • The products must be accompanied by the return coupon contained in the package; • The returned products must be sent to MISS BIKINI in a single shipment. MISS BIKINI, in fact, reserves the right not to accept items from the same order, returned and shipped at different times; • Miss bikini must receive the returned products within thirty (30) working days from the date on which you received the products.
If the Right of Withdrawal is exercised following the methods and terms indicated in the previous paragraph, MISS BIKINI will refund any sums already received for the purchase of the products, net of shipping costs for the delivery of the purchased products.
MISS BIKINI will refund you, in addition to the sums collected for the purchase of the products, also the shipping costs for the delivery of the purchased products, only in the event that the return of the products occurs for reasons attributable to MISS BIKINI, such as in the case in which the products do not possess the essential characteristics promised, or have manufacturing defects.
If the methods and terms for exercising your right of withdrawal are not respected, as specified, you will not be entitled to a refund of the sums already paid to MISS BIKINI; however, you will be able to get back, at your expense, the products in the state in which they were returned to MISS BIKINI. Otherwise, MISS BIKINI may retain the products, in addition to the sums already paid for their purchase.
If the integrity of the goods and seals is contested, MISS BIKINI will refund the customer within 30 working days from the date of return of the goods to the company. It will be the customer's responsibility to provide MISS BIKINI with the bank details (necessary only if the order was paid by cash on delivery), in order to obtain a refund of the price.
(*) In case of a refund under warranty, the customer will be responsible for the costs of returning the goods to MISS BIKINI. Furthermore, the costs of delivery to the customer will not be refunded.
The right to withdraw from the contract concluded with MISS BIKINI, can be exercised without any penalty and without specifying the reason, within 15 working days from the day of receipt of the products purchased on shopmissbikini.it It is understood that, according to the provisions of Article 67 of the Consumer Code, the substantial integrity of the product is an essential condition for exercising the right of withdrawal: therefore, used and/or deteriorated items following ordinary use will not be refunded. The returned goods will be refunded by reversing the original payment transaction, within 15 days from the date of verification of the return.

In this regard, we remind you that the times for crediting your credit card do not depend on us, but on the contract you have agreed with the card manager.
ATTENTION!! We invite you to pay the utmost attention when selecting the color of the product for sale. Any errors in the choice of variant will be replaced at the customer's expense. Remember that the items must arrive intact and in the same condition in which they were received, with the original packaging and tags indicating the bar code and any other material that is part of the package. The transport costs for the original shipment of the order will not be refunded.
ATTENTION: For orders outside the European Union, customs costs will be charged. These vary depending on the country and the goods ordered, therefore Miss Bikini is not aware of the amount until it arrives at the destination customs. L'amount is entirely borne by the customer, who will have to pay this tax at customs in order to collect his order. Orders placed from these countries cannot be returned.

b)The products marked with the MISS BIKINI LUXE brand, purchased on the website www.missbikini.it, are produced and sold by FASHION ONLINE SRLS. VAT number IT 17103761007 , Via Bolzano 28, 00198 Rome, Tel. +390633220067, mail: shop@missbikini.com c)The purchase operations are regulated, among other things, by the provisions of Legislative Decree no. 206 of 06.09.2005 (Consumer Code) according to which: I) "online sales contract" means the distance contract, i.e. the legal transaction having as its object movable goods and/or services stipulated between a professional, in this case FASHION ONLINE SRLS., via the online service www.missbikini.it, and a consumer, within the scope of a distance selling system organised by the professional who, for such contract, uses exclusively the distance communication technology called Internet; II) "professional" means the natural or legal person who acts in the exercise of his/her entrepreneurial or professional activity, or his/her intermediary; III) "consumer" means the natural person of age who acts for purposes other than any entrepreneurial or professional activity carried out.
ART. 1 ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE a) All contracts will be concluded directly by accessing the website corresponding to the address www.missbikini.it, where the customer can conclude the contract for the purchase of the desired goods and/or products by carefully following the instructions and procedures provided. b) These general conditions of sale are an integral and essential part of the sales contract, for this reason they must be examined "on line" by the customer, before completing the purchase procedure. Sending the order confirmation therefore implies full knowledge of the same and their full acceptance. c) The general conditions of sale can be updated or modified at any time by FASHION ON INE SR S. which will provide communication via the pages of the website. The customer undertakes and is obliged to print and keep them. d)The customer, by electronically sending the confirmation of his purchase order, unconditionally accepts and undertakes to observe, in his relations with FASHION ONLINE SRLS., the general conditions of sale, including the payment conditions illustrated below, declaring that he has read and accepted all the indications provided to him. e)FASHION ONLINE SRLS. does not consider itself bound by different general conditions unless previously agreed and accepted in writing.
ART. 2 SALES PRICES AND PURCHASE METHODS a)All sales prices of the products displayed and indicated on the website www.missbikini.it for which they constitute an offer to the public pursuant to art. 1336 cc, are inclusive of VAT and any other tax relating to the sale. b)The total cost of shipping and transport will be clearly indicated and displayed before completing the order. c)The purchase contract is completed through the exact compilation and consent to the purchase expressed through the adhesion given “on line”, subject to the successful completion of the payment. d)the customer can pay for the ordered goods using the payment methods indicated “on line” at the time of purchase.
ART. 3 DELIVERY METHODS a) Shipping costs Shipping costs are calculated based on the country of destination. Italy and the Republic of San Marino – €8.00. For other destinations, the price varies.
b)FASHION ONLINE SRLS. will deliver the selected and ordered products to the trusted courier, thereby completing the delivery, so that they can be transported to the customer, at the address indicated by him. c)FASHION ONLINE SRLS. will do its best to process the orders sent within 7 working days and in any case the purchased goods will be delivered within the terms of art. 54 of Legislative Decree 205/06, within 14 days from the day following the day on which the consumer sent the order to the professional. No responsibility can be attributed to MISS BIKINI for delayed or failed delivery attributable to force majeure or unforeseeable circumstances. d)the customer is required to verify, upon receipt, the conformity of the product delivered to him with the order placed; only after this verification, and obviously without prejudice to the right of withdrawal provided for in point no. 6, the customer must sign the receipt documents. By filling in the personal data sheet in the registration procedure required to activate the procedure for the execution of this contract and the related further communications, the consumer and/or customer authorizes FASHION ONLINE SRLS. to communicate non-sensitive personal data (residence, telephone number) to the trusted couriers and/or forwarders used for the delivery of the purchased goods in order to allow the procedures necessary for their delivery. e) Customs charges are always paid by the customer.
ART. 4 RESPONSIBILITY a)FASHION ONLINE SRLS. assumes no responsibility for disruptions attributable to force majeure such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, execution within the times agreed in the contract. b)FASHION ONLINE SRLS. will not be liable towards any party or third parties for damages, losses and costs incurred as a result of failure to execute the contract for the reasons mentioned above, the customer being only entitled to a refund of the price paid. c)Similarly, FASHION ONLINE SRLS. is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, cheques and other means of payment, upon payment for the products purchased. FASHION ONLINE SRLS. , in fact, at no point during the purchase procedure is it able to know the customer's credit card number which, by opening a protected connection, is transmitted directly to the banking service manager.
ART. 5 CUSTOMER OBLIGATIONS a)FASHION ONLINE SRLS. produces and sells high quality clothing and accessories; however, if the products ordered are found to be defective, the consumer is required to report the defect in writing by email within ten days of discovery, under penalty of forfeiture. b)the customer undertakes and agrees, once the “online” purchase procedure has been concluded, to print and keep these general conditions, which, moreover, he/she will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased, and this in order to fully satisfy the condition set out in articles 52 and 53 of Legislative Decree 205/06; c)minors are strictly prohibited from placing an “online” order. d) the customer is strictly prohibited from entering false and/or invented and/or imaginary data in the registration procedure required to activate the process for the execution of this contract and the related further communications; the personal data, address, telephone number and e-mail address must be exclusively their own real personal data and not those of third parties or imaginary data. e) it is expressly forbidden to enter third party data. FASHION ONLINE SRLS. reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers. f) the customer indemnifies FASHION ONLINE SRLS. from any liability arising from the issuing of incorrect tax documents due to errors relating to the data provided by the customer, being the customer himself solely responsible for the correct entry.
ART. 6 RIGHT OF WITHDRAWAL AND COMPLAINTS a) Pursuant to art. 64 of Legislative Decree 205/06, the consumer may exercise the right of withdrawal and return the product received, in compliance with the terms and conditions set out below. b) The consumer who for any reason is not satisfied with the purchase made has the right to withdraw from the contract stipulated, within 15 days from the delivery date. c) If the consumer has exercised the right of withdrawal, he must make the return request following the procedure indicated. The items must be returned and arrive intact and in the same condition in which they were received, with the original packaging and tags indicating the bar code and any other material that is part of the package. d) In the event that all the conditions and obligations of the consumer set out in the previous points have been respected, FASHION ONLINE SRLS. will refund the sale price of the purchased item by direct crediting to the card used for payment or to the PayPal account, within 15 working days from the date of receipt of the goods by our logistics. e) The consumer who wishes to change size or color can place a new order. f) In the event of returns following errors by the Company FASHION ONLINE SRLS. (wrong size, non-compliant color, etc.), simply send an email to m.mascolo@missbikini.com indicating the order number / receipt number / items you wish to return and briefly explaining your request. In this case, the Company will respond as quickly as possible, providing all the information necessary for the correct resolution of the problem.
ART. 7 PAYMENT METHODS a) By filling in the appropriate space on the website of the payment banking system, the consumer and/or customer authorizes FASHION ONLINE SRLS. to use their credit card and to debit their account in favor of FASHION ONLINE SRLS. the total amount shown as the cost of the purchase made “online”. The entire procedure takes place via a secure connection directly linked to the banking institution that owns and manages the online payment service, which FASHION ONLINE SRLS. cannot access. b) Should the consumer exercise the right of withdrawal, as provided for in these contractual conditions, the amount to be refunded will be credited directly to the credit card or PayPal account.
ART. 8 EXPRESS TERMINATION CLAUSE a)FASHION ONLINE SRLS. has the right to terminate the contract entered into by simply notifying the consumer and/or customer with adequate and justified reasons; in this case the customer will be entitled exclusively to the refund of any sum already paid. b)The obligations undertaken by the customer pursuant to art. 7 of these conditions (customer obligations) as well as the guarantee of successful payment that the customer makes using the methods referred to in art. 2, are essential, so that by express agreement, the failure by the customer to comply with just one of said obligations will determine the termination of the contract pursuant to art. 1456 of the Civil Code, without the need for a judicial ruling, without prejudice to the right of FASHION ONLINE SRLS. to take legal action for compensation.
ART. 9 JURISDICTION AND COMPETENT COURT a)Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated “on line” through the website www.missbikini.it is subject to Italian jurisdiction; these general conditions refer, for anything not expressly provided for therein, to the provisions of the Civil Code, as well as Legislative Decree 205/06. b)For any dispute between the parties regarding this contract, the Court in whose district the consumer has his/her domicile will be competent.

REFUND TIMES AND METHODS If the integrity of the goods and seals is contested, MISS BIKINI will refund the customer within 15 working days from the date of return of the goods to the company. It will be the customer's responsibility to provide MISS BIKINI with the bank details (ABI CAB Current Account Code of the holder of the delivery note), in order to obtain a refund of the price.
